Listing terms

Between: Craig Chambers, doing business as SWPPP HQ, Anderson, SC ("we", "us"), hello@swppphq.com, and the business or person requesting or managing a listing ("you").

1. What these terms cover

These terms apply to free listings you request, correct, or manage, and to paid featured listings in the SWPPP HQ directory. By requesting, claiming, or editing a listing, uploading photos, or buying a Featured (ad) listing, you agree to them.

2. Types of listings

a. Free listing.

A free listing shows your business name, counties served, service types, phone or email, website link, and any certification you report, with a link to Clemson's list.
It appears in the county and service search. It stays free, nobody pays to appear in the free listings, and you never have to upgrade. We won't start charging for a free listing, and changes to these terms won't make it paid. If a featured listing is canceled or ends, it goes back to a free listing. You may ask us to correct or remove it. Buying, canceling, or never buying a Featured (ad) listing doesn't change what your free listing says or where it appears.

b. Featured listing (advertisement).

Where it shows. A Featured listing shows only on the county pages for the South Carolina counties you pick as your service area in your listing. If you change those counties, the places it shows change to match. It doesn't show on county pages for counties you haven't picked.

Top spots and taking turns. Each county page shows up to 3 Featured listings at the top of that county's results. When more than 3 Featured listings serve a county, they take turns: every time the page loads, the Featured listings for that county are shuffled at random. No spot, position or number of views is guaranteed. Featured listings that aren't in the top 3 on a given page load still appear lower in that county's results, labeled "Featured (ad)." All Featured listings in a county are treated the same, and no one can pay more for a higher spot.

No guarantee. We don't guarantee any spot, position, number of page loads in the top 3, or number of views, calls, or jobs.

Always labeled. A Featured listing is an advertisement and is always labeled "Featured (ad)" wherever it appears. It may show:

your logo
a short description
photos
your website, and your phone as a click-to-call button
your services

Featured status doesn't change any customer reviews (if we ever show them), what our guides say, or any free listing.

3. Price: flat fee only

Price: $10 per month or $100 per year, as you choose, paid in advance through Stripe.
Flat fee only. We charge no per-lead, per-click, or per-contact fees, no commissions, no referral fees, and no fees based on any work you get. We don't sell or forward "leads". Visitors contact you directly.
Taxes: No sales tax is charged.

4. Renewal and cancellation

Who you're dealing with. Featured listings are sold by Craig Chambers, doing business as SWPPP HQ ("we", "us").
Automatic renewal. A Featured (ad) listing is a subscription. It renews automatically at the end of each billing period, monthly ($10) or yearly ($100), at the price shown when you signed up, until you cancel. We charge the payment method on file (a card, or the payment method you chose in Link) on the renewal date. No sales tax is charged.
Cancel online, as easily as you signed up. You can cancel anytime online through our secure Stripe customer portal at https://swppphq.com/api/featured/cancel. No phone call or reason is needed. You can also email hello@swppphq.com from the address on your account with the subject "Cancel". We'll confirm by email within 2 business days, and the cancellation is effective as of the date you sent it.
When cancellation takes effect. Cancellation stops all future charges. Your listing stays Featured until the end of the period you've already paid for. Then it goes back to a free listing, unless you asked us to remove it.
Removing your whole listing. To remove your listing entirely (free or Featured), email hello@swppphq.com with the subject "Removal", or use "Manage or cancel your listing." We'll remove it from the site within 1 business day. If it was Featured, removing it also cancels the subscription and stops all future charges. Refunds follow "Refunds" below.
Reminder before annual renewals. For yearly plans, we email you 30 days before each renewal date. The email gives the renewal date, the amount, and how to cancel.
Receipts. We email a receipt for every charge, monthly or yearly. It shows the amount, the date, and a link to manage or cancel.
Price changes. We'll email you at least 30 days before any price change takes effect, including if we ever have to start charging sales tax. A new price or tax applies only from your next renewal after that notice. If you don't want to pay it, cancel before that renewal. For yearly plans, the change is shown in bold in the renewal reminder.
Refunds. Payments are non-refundable, except where the law requires a refund. If we bill you in error, or after you cancelled, we'll refund that charge in full. If we remove a Featured listing or stop offering Featured listings for a reason other than your breach of these terms, we'll refund the unused part of your prepaid fee.
Failed payments. If a renewal charge fails, we'll email you. If it isn't fixed within 7 days, your listing goes back to a free listing.

5. Your responsibilities

You promise that:

You're authorized to manage the listing for this business.
Your information is true and current: business name, contact details, services, service area, certifications, and licenses. You'll update us within 30 days if anything changes or expires.
Licenses and certifications.
- You hold every license, registration, and certification your listing claims or that your listed services legally require.
- We don't accept listings that offer SWPPP or C-SWPPP preparation, engineering, surveying, or landscape architecture.
- Your business doesn't sell engineering, surveying, design or plan-preparation services or sign permit certifications for clients, and your listing describes only inspection, pond, erosion-control or supply services. Licensed engineers may be on your team, but your listing can't describe engineering, design, or plan or SWPPP preparation.
- Your listing won't describe you as an engineer, surveyor, or landscape architect, or offer design, plan or SWPPP preparation, or certification of compliance.
Insurance. You carry any insurance the law, your clients, or your services require. We don't verify insurance.
Your ad content is lawful and accurate.
- It contains no false or misleading claims, and nothing that suggests government, SCDES, or Clemson approval or affiliation.
- It doesn't use any agency's or university's logo or seal.
- It doesn't infringe anyone's rights, and it follows the advertising and solicitation rules of your own licensing board.
Logo, photos, and text. You own the logo, photos, and text you give us, or have the right to use them and to let us display them.
- Real photos of your own work only. Photos must be real photographs of work your business did. No AI-generated images, no stock photos, and no photos edited to change what the work looked like.
- People. Anyone who can be recognized in a photo must have agreed to be shown.
- No seals or logos. Photos can't show any government, agency (including SCDES), county, city, or university seal or logo, or anything suggesting government approval.
- Files. JPEG, PNG, or WebP only, up to 10 MB each. Up to 6 photos plus 1 logo.
- Checkbox. You confirm these points by ticking the photo checkbox before uploading, and we keep a record that you did.
- License. You give us a non-exclusive, royalty-free license to copy, resize, crop, and display your logo, photos, and text on SWPPP HQ for your listing, and in screenshots of the site showing your listing, while your listing is up. The license ends when your listing or the photo is removed, except for copies we must keep under section 9 or the Privacy Policy.
- Removal. We may decline, crop, resize, or remove any logo, photo, or text at any time, including after a complaint.
- Rotation. If your listing has more than 3 photos, the photos shown on your listing card may rotate among them.

6. What we do and don't check

We check public credentials only. Before a listing goes live:
- We compare any certification number you give us against Clemson's public lists.
We don't verify insurance, quality of work, business standing, or other claims. We rely on your promises in section 5.

7. No endorsement

A featured listing is an advertisement. It is not a recommendation, rating, referral, or endorsement by us or by any agency or university.
Paying doesn't change what our guides say, any customer reviews, or any free listing.
Being listed doesn't mean we recommend, verify, or endorse a business, or that it endorses us or is our customer.
We don't guarantee any number of views, calls, or jobs.

8. Our right to refuse, shorten, or remove listings

We may refuse, shorten, reformat, suspend, or remove any listing at any time. We won't change what a listing says about your business without asking you. Examples include when:

information appears inaccurate
a license or certification has expired or can't be confirmed
we receive a credible complaint
content breaks these terms or the law
the person listed asks us to remove a free listing
we stop running the directory or a region

Refunds follow section 4.

9. Corrections and removal requests

Anyone listed may ask us to correct or remove their listing by emailing hello@swppphq.com (subject "Correction" or "Removal").
We'll remove a listing within 1 business day and make corrections within 10 business days.
When a listing is removed, we take its photos and logo off the site at the same time and delete them from our file storage within 30 days. Anyone shown in a listing photo, or who owns a photo, may ask us to remove that photo by emailing hello@swppphq.com with the subject "Photo removal". We'll take it down within 1 business day while we look into it.
Removing a listing from our site doesn't change Clemson's or any agency's records.

10. Data accuracy

Directory and guide information comes from you, from public sources, and from our own work. It may be incomplete, out of date, or wrong.
The directory is provided "as is" and "as available".
To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy.

11. Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or business, arising from the directory or your listing.
Our total liability for all claims about your listing is limited to the fees you paid us for it in the 12 months before the claim, or $100 if you paid nothing.

12. Indemnity

You'll defend and indemnify us against third-party claims arising from your listing content, your services, or your breach of these terms.

13. Communications

We'll contact you by email about your listing and billing, including receipts and renewal reminders. We won't send you marketing emails, including offers to upgrade, unless you've asked us to.
We won't make sales calls or send texts to you unless you've agreed in writing.
We won't sell or share your contact details for others' marketing.

14. Changes to these terms

We may update these terms by posting a new version with a new effective date, and emailing active featured listees at least 30 days before a change affecting price or renewal.
We'll also email active Featured listees at least 30 days before a change to where Featured listings appear or how they take turns. That change applies from your next renewal after the notice, and you may cancel before then.

15. Governing law and venue

These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules.
Any dispute will be brought in the state or federal courts located in Anderson County, South Carolina.

16. Other

These terms, plus the Privacy Policy and the listing details you submitted, are the whole agreement about your listing.
If any part is unenforceable, the rest still applies.
You may not transfer your listing without our consent.
